§ 1. Description of service:
The services allows you to electronically access all on our web-site provided videos by internet while using a standard software.
The customer is able to access multiple videos (from now on refered to as Online-Abo).
You can only access the videos as a register user and/or subscriber of the Online-Abo (from now on refered to as: subscriber).
An agreed-on contract according to our general business-conditions is necessary.
The Online-Abo 777cinema is a premium-rate-service which only can be used by internet.
§ 2. Registration:
By registration the user is allowed a temporally limited test-access to our membership site totally free of charge.
With registration the user establishes a contract with 777-System N.V..
777-System N.V. reserves itself the right to reject selective registrations without further justification.
All provided data will be saved by 777-System according to common data protection regulations.
§ 3. Charges:
The user has the possebility to commit to an Online-Abo at any time.
While doing so the user will be informed about the exact charges due, can select his prefered method of payment and any further needed data will be collected.
All charges are subject to change and current prices are published by 777-Systems N.V. on the internet-site 777cinema.
The initiale charges to subcribe to the Online-Abo will be charged right away.
The subscriberis in agreement that all receipts for the total charges will be send to subscriber by e-mail to the submitted e-mail address.
If receipts are requested in paper and writing the 777-System N.V. will charge an appropriate fee to accomidate your request.
By committing to the Online-Abo the subscriber is entitel to use the service for the entire time indicated in contract.
Temporal interruptions or breaks of the subcribed time period are not possible, therefore no refunds of charges or partial charges will be paid.
Since the charges for the Online-Abo may vary, all current charges will be published and updated on the homepage 777cinema.
If the increase of updated charges will exceed 5% the subcriber is entiteled to cancel the contract for the end of the month the increase did occur.
§ 4. Terms of usage:
Login-name and password will be used for authentication to enter the site and access video-clips.
Please make sure these informations are confidental and not to be accessable to third parties.
The 777-System N.V. may cancel the accessabilty to the Online-Abo in case of abuse or damages to the system have accured by making information to access the site available to third parties.
Same case scenario if informations about the content of Online-Abo is been made available to third parties.
Should these cases occur the subscriber will be held responsable for all resulting damages and still will be charged for the entire amount due by contract eventhough the Online-Abo has been canceled.
§ 5. Copyrights:
Any use extending the terms of § 4 is illegal and and will be pursued by the fullest extend of the law.
This includes all unautorized use like publishing, copying and downloding of all copyrighted videos, pictures, etc. onto any kind of media or internet and intranet.
Any use of content is permitted only for private usage. Any exposure to third parties, public or commercial usage of content is illegal and needs to be negotiated by contract in writing with 777-System N.V..
§ 6. Liability:
It is the intent of 777-Systems N.V. to make the 777cinema accessable to the subscribers 24 hours, 7 days a week.
In case this accessability is temporally not available due to transmission problems of internet or due to higer force, 777-System cannot been held responsable and will not grant any discounts or refunds in any form.
Temporally interruptions because of maintenance, transmission problems by external providers and due to higher force are possible and not foreseeable.
In any case 777-System N.V. cannot been held accountable for possibly occuring interruptions and will not grant any discounts or refunds.
777-System will act according to legal regulations, in case of claim for damages from subscriber side, if the cause of damages did undeniable origin by 777-System, its representatives or associates.
777-System can also been held responsable if substantial obligations by contract have been violated. Entitled claims will be handled and satisfied according to the expected and foreseeable extend of damages.
Any claim for damages cannot be accepted 12 month after provided service in question.
Any liability for damages to life, health, body or mind will remain untouched. Same is applicable for the liability of the "Produkthaftungsgesetz".
Any liabilities extending the terms of the above are excluded. This applicates to 777-Systems N.V., it's representatives and associates.
§ 7. Data Protection
Login-name and password are needed for authentication to subscribe to the Online-Abo 777cinema.com and connection sites.
THe password needs to be proteted by the user and under no circumstances may be made accessable to third parties.
Any personal data needed from users by 777-Systems N.V., its partners and associates in order to provide service or collect poayments, under no circumstances will not be made accessable to anyone, except the user agrees or is being permitted by law or court order.
All info are subject to the data protection act.
§ 8. Cancelation
With establishing the contract for service of 777cinema.com there will be a 14-days cancellation period.
The cancellation period will automatically be canceled after the site has been opened and viewed with provided access-data (user-name and password) once.
Once the site been accessed or the 14-days cancellation period has passed, the Online-Abo can be cancelled with a 4-weeks notice for the end of each month or for the end of the initial subscribing period (to be payed upfront).
777-System reserves the right to cancel the contract premature or to charge additional fees in case access-data have been made available to third parties by user/subscriber.
§ 9. Court of jurisdiction
Court of jurisdiction for all legal disputes which concern 777-System Online-Abo will be the place of registration of 777-System.
This concerns all disputes between 777-System and user/subscriber if they are a company or represent company/ies, public and/or government office.
§ 10. Miscellaneous
If one or more terms or conditions of the contract is/are not applicable, all other terms and conditions will still be in effect.
All affected parties hereby shall find ways to mediate in order to fit or come close to the initial content (in dispute) of contract.
This will also be the case the contract proves to be incomplete or/and unexecutable.
